Welcome to AC TCG. We're a family-owned, collector-run retail business based in Kokomo, Indiana. These Terms of Service explain the rules that apply when you visit our website, shop with us online, create an account, place an order, or otherwise use our website and related services.
Throughout these Terms, “AC TCG,” “we,” “us,” and “our” refer to AC TCG. Our website, online store, content, features, tools, products, and related services are collectively referred to as the “Services.”
Our online store is powered by Shopify, which provides the ecommerce platform that allows us to offer products and Services to you.
By accessing or using the Services, you agree to these Terms of Service and the policies referenced below. If you do not agree with these Terms, please do not use the Services.
1. Using Our Website & ServicesBy using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you are the age of majority and have authorized any minor dependents under your supervision to use the Services.
You agree to provide accurate, current, and complete information when creating an account, placing an order, contacting us, or otherwise using the Services.
If you create an account, you are responsible for maintaining the security of your login information and for activity occurring through your account.
We reserve the right to refuse service, suspend accounts, or restrict access when reasonably necessary to prevent fraud, abuse, unlawful activity, violations of these Terms, or harm to AC TCG, our customers, or others.
2. Products & Product InformationWe make reasonable efforts to accurately describe and display the products offered through our website.
Product colors, packaging, finishes, artwork, and other characteristics may appear differently depending on your screen, device settings, manufacturer variations, or production differences.
Many of the products we sell are collectibles. Minor factory imperfections, packaging variations, print variations, paint inconsistencies, surface marks, or similar manufacturing characteristics may occur and do not necessarily constitute a defect.
When the condition of an item or its packaging materially differs from what a collector would reasonably expect, we make reasonable efforts to disclose that condition in the product listing.
Product descriptions, specifications, availability, images, and other listing information may be updated or corrected at any time.
3. Orders & Order AcceptanceSubmitting an order constitutes an offer to purchase the products included in that order. Receiving an order confirmation does not necessarily mean that the order has been finally accepted or fulfilled.
We may decline, cancel, reduce, or modify an order when reasonably necessary, including because of:
- Product availability or inventory errors
- Pricing, listing, or promotional errors
- Suspected fraud or unauthorized payment activity
- Purchase-limit violations
- Attempts to circumvent product limits
- Payment or verification issues
- Technical or system errors
- Other circumstances that prevent us from reasonably fulfilling the order
If AC TCG cancels all or part of an order after payment has been collected, the applicable amount will be refunded to the original payment method.
Returns, refunds, exchanges, and customer-requested cancellations are governed by our Return and Refund Policy.
4. Purchase Limits & Fair AccessCertain high-demand, limited-release, allocated, promotional, or collectible products may be subject to purchase limits.
Purchase limits may apply per person, household, customer, account, address, payment method, or other reasonable criteria identified by AC TCG.
We reserve the right to reduce or cancel quantities when we reasonably believe that a customer has attempted to circumvent a posted purchase limit, including through multiple orders, accounts, names, addresses, or payment methods.
These limits are intended to promote fair access to limited products for our collector and player community.
5. Pricing, Promotions & PaymentPrices, promotions, discounts, and product availability are subject to change.
The price charged for a product will generally be the price displayed when the order is submitted, subject to correction of obvious pricing, listing, or technical errors.
Unless otherwise stated, displayed prices do not include applicable taxes, shipping charges, customs duties, import fees, or similar charges.
Online prices and promotions may differ from those offered at our physical store, vendor events, marketplaces, or other sales channels.
Promotions may be subject to additional terms such as expiration dates, exclusions, minimum purchase requirements, purchase limits, or restrictions on combining discounts.
You agree to provide accurate billing and payment information and represent that you are authorized to use the payment method submitted with your order.
6. Shipping & In-Store PickupShipping and fulfillment are governed by our Shipping Policy.
Shipping and delivery dates are estimates unless expressly stated otherwise. Delays may occur because of carriers, weather, holidays, service disruptions, major releases, or other circumstances outside our reasonable control.
Free in-store pickup may be available for eligible online orders at our Kokomo retail location.
Please wait until you receive confirmation that your order is ready before arriving for pickup.
We may request an order confirmation, identification, or other reasonable verification before releasing an order when necessary to prevent fraud or ensure that an order is provided to the correct customer.
7. Collectibles, Trading Cards & Market ValuesAC TCG sells products whose secondary-market values may fluctuate, including trading cards, graded cards, sealed TCG products, diecast vehicles, figures, and other collectibles.
We do not guarantee that a product will retain, increase, or decrease in value after purchase.
Current or future market value, resale value, rarity, scarcity, collectibility, grading outcome, population report, or investment performance is not guaranteed unless expressly stated otherwise.
For raw or ungraded trading cards, any condition designation provided by AC TCG represents our reasonable assessment at the time the card is listed or sold. Card condition can involve some degree of subjectivity.
We do not guarantee that an ungraded card will receive any particular grade from PSA, CGC, Beckett, SGC, or another third-party grading company.
Third-party graded items are sold based on the certification and grade assigned by the applicable grading company. AC TCG does not control the standards, decisions, or future actions of those grading companies.
8. Returns, Refunds & CancellationsReturn eligibility varies by product type.
Certain products, including trading card singles, graded trading cards, sealed trading card game products, and other designated merchandise, may be final sale.
Eligible non-final sale merchandise may qualify for return under the conditions described in our Return and Refund Policy.
Eligible non-final sale online orders may also have a limited cancellation window as described in that policy.
Our Return and Refund Policy governs all returns, refunds, exchanges, restocking fees, and customer-requested cancellations.
9. Intellectual PropertyUnless otherwise indicated, original content created by AC TCG, including our text, photographs, graphics, videos, logos, page designs, and other original materials, is owned by or licensed to AC TCG and protected by applicable intellectual property laws.
You may access and use our website for personal, non-commercial purposes.
You may not reproduce, distribute, modify, republish, sell, commercially exploit, scrape, or otherwise use our original website content without our prior written permission except where permitted by law.
Manufacturer names, game names, character names, artwork, trademarks, logos, and other intellectual property belonging to third parties remain the property of their respective owners.
The sale or display of third-party products by AC TCG does not imply sponsorship, endorsement, or affiliation unless expressly stated.
10. Reviews, Feedback & Customer ContentIf you voluntarily submit reviews, photographs, comments, suggestions, feedback, or other content to AC TCG, you represent that you have the right to submit that content.
By submitting content for public display through our website or related interactive features, you grant AC TCG a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content in connection with operating, improving, and promoting our business and Services.
We may decline to publish or remove content that we reasonably determine is unlawful, fraudulent, abusive, defamatory, obscene, misleading, infringing, unrelated to the product or service being reviewed, or otherwise inappropriate.
You remain responsible for content you submit.
11. Third-Party Tools, Services & LinksOur website may provide access to services, payment processors, applications, integrations, websites, or tools operated by third parties.
Those third parties may have their own terms, policies, and privacy practices. AC TCG does not control and is not responsible for the content, security, availability, or practices of third-party services.
Your use of third-party services is subject to the terms and policies applicable to those services.
12. ShopifyOur online store is powered by Shopify.
Purchases made through our Shopify-powered store are transactions between you and AC TCG. Shopify provides the ecommerce technology used to facilitate those transactions but is not the seller of products purchased from AC TCG.
Certain information may be collected or processed by Shopify and other service providers in connection with operating our online store. Please review our Privacy Policy for additional information.
13. PrivacyPersonal information collected through the Services is handled in accordance with our Privacy Policy.
Certain information may also be collected, processed, stored, or transmitted by Shopify and other service providers as necessary to operate the Services, process payments, prevent fraud, fulfill orders, conduct analytics, and provide customer support.
14. Errors, Inaccuracies & OmissionsInformation on our website may occasionally contain typographical errors, inaccurate inventory information, incorrect pricing, promotional errors, omissions, or other mistakes.
We reserve the right to correct errors, update information, or cancel affected orders when reasonably necessary, including after an order has been submitted.
If an affected order is canceled after payment has been collected, the applicable amount will be refunded to the original payment method.
15. Prohibited UsesYou may use the Services only for lawful purposes.
You may not use the Services to:
- Violate applicable laws or regulations
- Commit or facilitate fraud
- Submit false, deceptive, or misleading information
- Infringe intellectual property, privacy, or other legal rights
- Harass, threaten, abuse, defame, or unlawfully harm another person
- Impersonate another person or organization
- Introduce viruses, malware, malicious code, or other harmful technology
- Interfere with or circumvent website security or functionality
- Engage in unauthorized scraping or automated purchasing activity
- Use bots or automation to unfairly access limited products
- Attempt to circumvent posted purchase limits
- Collect personal information about other users without authorization
- Engage in fraudulent payment or chargeback activity
We reserve the right to restrict or terminate access to the Services for violations of these Terms.
16. TerminationWe may suspend or terminate access to all or part of the Services when reasonably necessary because of a violation of these Terms, suspected fraud, unlawful activity, abuse, security concerns, or conduct that materially harms AC TCG, our customers, or others.
Termination does not eliminate obligations or liabilities that arose before termination.
Provisions that should reasonably survive termination will remain in effect, including provisions concerning intellectual property, limitations of liability, indemnification, governing law, and accrued rights or obligations.
17. Disclaimer of WarrantiesTO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
EXCEPT AS EXPRESSLY PROVIDED BY AC TCG OR REQUIRED BY LAW, WE DISCLAIM WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
18. Limitation of LiabilityTO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AC TCG AND ITS OWNERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.
THIS MAY INCLUDE LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF USE, OR LOSS OF ANTICIPATED VALUE.
NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
19. IndemnificationTo the extent permitted by law, you agree to indemnify and hold harmless AC TCG and its owners, employees, agents, contractors, service providers, and affiliates from third-party claims, liabilities, damages, losses, and reasonable costs arising from:
- Your material breach of these Terms
- Your violation of applicable law
- Your infringement of another person's rights
- Your unlawful or unauthorized use of the Services
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary.
The remaining provisions will continue in full force and effect.
21. Waiver & Entire AgreementOur failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any additional applicable terms posted on our website, constitute the agreement governing your use of the Services.
22. AssignmentYou may not transfer or assign your rights or obligations under these Terms without our prior written consent.
AC TCG may assign or transfer its rights and obligations in connection with a sale, transfer, reorganization, or other lawful change involving the business.
23. Governing LawThese Terms and disputes arising from or relating to the Services will be governed by the laws of the State of Indiana, without regard to conflict-of-law principles, except where applicable federal law controls.
To the extent permitted by law, disputes arising from these Terms or the Services will be subject to the jurisdiction of the appropriate state or federal courts serving Howard County, Indiana.
24. Changes to These TermsWe may update these Terms of Service from time to time to reflect changes to our business, Services, policies, or applicable legal requirements.
The current version will be posted on this page with the applicable “Last updated” date.
Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by law.
